As with DWI, the stakes are high: loss of driver’s license is a major issue, having a criminal record, significant jail time, and both fines and mandatory penalties that can be severe. You need an attorney because so much is at stake.  He will challenge the search, the chain of custody, and science used by the state.

Clients have options – they don’t necessarily have to face jail time:

New Jersey utilizes a Drug Court System, where in-patient treatment is emphasized over jail.  The goal is rehabilitation.  This represents an attractive alternative for many clients over incarceration.

For first time offenders, the state offers a Pretrial Intervention program (“PTI”):  this is a diversionary program where the court impose conditions (e.g., drug testing, mental health evaluation, compliance with treatment conditions) which if successfully completed can result in dismissal of the charges.
