Driving While Intoxicated (DWI)

Often DWI charges also include traffic offenses and disorderly person offense, or felony offenses.
Mr. Weisberg will analyze the issues, spotting “red flags” in the state’s case, and recignize the weaknesses that may lead to evidence, or the entire case to be thrown out or dismissed. Anaisys includes:

  • Challenging officer qualifications and observations
  • Challenging technical violations, e.g. testing equipment
  • Challenging state’s chain of evidence

In New Jersey, there is no plea bargaining in DWI cases.  You MUST win the case.  You MUST raise reasonable doubt. With DWIs, time is of the essence – as soon as you know the weaknesses of the state’s case, the more effectively you can fight it.  According to the court rules, a DWIs should be resolved within 60 days of the arrest. As soon as an attorney reviews the evidence, the better off you are.
